Buying or selling a second-hand car comes with its own set of mandatory legal procedures. The most important aspect of this is the transfer of the ownership of the vehicle. This has to be done within 30 days of the vehicle's purchase. You can do this in Kolkata at the Regional Transport Office (RTO) where you reside.
It is mandatory that the owner of the vehicle completes the transfer of vehicle ownership within 30 days of purchase. If the owner has bought a car which is registered at an RTO that is not at the place where they reside, then an NOC has to be obtained from the RTO where it was registered. This has to be submitted along with other documents for vehicle ownership transfer to the RTO where they reside. There is a fine of Rs.500 if the transfer is not completed within 30 days.

This is applicable if the buyer and seller are residing in different RTO jurisdictions in the city. If the car is not registered in the state of West Bengal itself, then it will have to be de-registered in the state where it is currently registered and then the process of transfer of vehicle ownership can be initiated.
If you have to get an NOC from another state, then submit the duly filled in Form 28 to the original RTO. Also, you must obtain a Form 29 from the same RTO.
If the vehicle is registered in Kolkata but not in the RTO where you reside, then you will also have to obtain an NOC from the original RTO before you initiate the transfer of vehicle ownership process.
Once you have made the payment of the required fees the transfer at the RTO, the ownership will be transferred within 30 working days.

If the second-hand car was not registered in West Bengal, you will need to pay the road tax to the local RTO, which is calculated on the basis of the original invoice. This can also be claimed as a refund if you had already paid road tax in the original state. The refund amount is calculated on the basis of the vehicle's age.
